GENERAL TERMS AND CONDITIONS (AGB)

1. GENERAL PROVISIONS
1.1 Scope
These General Terms and Conditions (hereinafter referred to as the “Terms”) govern the relationship between Blue Card Agency GmbH (hereinafter referred to as the “Agency”) and clients using the Agency’s services (hereinafter referred to as the “Client”).

1.3 Language Version
These Terms are a translation of the German version and are provided for informational purposes only. The German version of the document shall prevail in case of discrepancies.
2. SUBJECT OF THE AGREEMENT
2.1 Services
The Agency provides relocation-related services to Germany, including but not limited to:
- Visa support
- Assistance with document legalization
- Relocation consulting services
- Job search assistance
- Support in dealing with public authorities
- Assistance with residence permit applications
- Recognition of diplomas and qualifications
- Language support
- Concierge services
3. CONCLUSION OF THE CONTRACT
3.1 Contract Formation
A contract shall be deemed concluded after:
- Confirmation of the service order by the Client
- Payment of the selected service package or individual service
- Confirmation from the Agency
3.2 Right to Refuse
The Agency reserves the right to refuse service provision without stating reasons.
4. SERVICE FEES AND PAYMENT TERMS
4.1 Prices
The price of services is determined according to the current company tariffs and specified in the individual agreement.
4.2 Payment Terms
Payment must be made in full (100% prepayment) prior to the commencement of services.
4.3 Additional Costs
Government fees, administrative charges, translations, and similar external expenses are not included in the service fee and shall be paid separately by the Client.
5. OBLIGATIONS OF THE PARTIES
5.1 Obligations of the Agency
The Agency undertakes to:
- Provide services professionally and within agreed timelines
- Maintain confidentiality of Client information
- Inform the Client about the progress of services
- Provide up-to-date information on relocation processes
5.2 Obligations of the Client
The Client undertakes to:
- Provide truthful and accurate information and documentation
- Pay for services on time
- Submit required documents:
- No later than 30 days before the planned initial submission to authorities
- No later than 10 days after receiving a request for additional documents from authorities
- Inform the Agency in advance of any actions or changes that may affect the immigration process or ID card issuance
5.3 Rights of the Agency
5.3.1 Third Parties
The Agency has the right to engage third parties for contract performance and provide them with necessary information.
5.3.2 Termination by Client
In case of cancellation or early termination initiated by the Client:
- The Agency retains payment for services already rendered
- Additionally, 10% of the total contract amount is retained as a contractual penalty
- The remaining balance shall be refunded
5.3.3 Termination Due to Client Conduct
In cases where the Client:
- Has not been reachable for more than three months and subsequently requests a refund;
- Fails to take necessary actions (e.g., does not submit documents, does not attend authorities, or otherwise delays the process),
The Agency may retain 10% of the total service value as compensation for expenses related to incomplete services.
6. RIGHT OF WITHDRAWAL (WIDERRUFSRECHT)
6.1 The Client has the right to withdraw from the contract within 14 days of its conclusion without providing reasons.
6.2 Withdrawal must be made in writing.
6.3 If services have begun before the withdrawal period expires with the Client’s consent, payment shall be refunded minus:
- The value of services already provided;
- A contractual penalty of 10% of the total contract value.
6.4 Termination for Breach
The Agency may terminate the contract in case of violation of Clause 5.2 by the Client. In such case, only 50% of the value of unperformed services shall be refunded.
7. LIABILITY
7.1 The Agency is responsible for:
- Quality of services
- Data confidentiality
- Timely information provision
- Client support
- Compliance with contractual obligations
7.2 The Agency is not responsible for:
- Decisions made by governmental authorities
- Delays beyond the Agency’s control
- Incomplete or inaccurate information provided by the Client
- Changes in legislation or governmental requirements
8. DATA PROTECTION
8.1 The Agency processes personal data in accordance with the General Data Protection Regulation (GDPR) and applicable German data protection laws.

9. APPLICABLE LAW AND JURISDICTION
9.1 These Terms are governed by the laws of the Federal Republic of Germany.
9.2 Place of jurisdiction is Berlin, Germany.
10. FINAL PROVISIONS
10.1 Amendments
Changes and additions to these Terms must be made in writing.
10.2 Severability
If individual provisions of these Terms are invalid, the validity of the remaining provisions shall remain unaffected.
10.3 Language Version
In case of discrepancies between language versions, the German version shall prevail.
10.4 Refund Policy
10.4.1
Refunds are possible only for services not yet performed at the time of the refund request.
10.4.2
No refunds are provided for services already fully or partially performed.
10.4.3
Refund requests must be submitted in writing to the company’s contact address.
10.4.4
Refunds will be processed within 30 days from approval of the request.
